
Should you have the lease or freehold for sale – for a lease this is known as an assignment, and for a freehold sale it is known as a transfer – you or your prospective purchaser may wish to find out more information relating directly to your property.
The TMO does provide information such as possible major works schemes that are likely to take place in the next 5 years; final accounts for the last 3 years; the percentage of sold flats in your block or estate; your estimated charges for the year; your current account balances; details of your buildings insurance cover; etc.
Under the legislation, landlords are able to make a charge for this information, but can only provide it to the leaseholder or their solicitor or representative, following written application.
Your TMO/EMB Officer will deal with these sort of enquiries.
However, if you do sell your property, you will still be held responsible for the charges unless a Deed of Covenant form is completed by the purchaser, taking away that responsibility.
This Deed together with registration fees should be provided to The Director of Legal Services.
