Are there any reasons that you may refuse the exchange?

Yes. There are certain factors that we can consider before agreeing to your exchange:

  • If either you or the other tenant has had a notice seeking possession served on them or legal possession proceedings have begun.
  • If you or either tenant have been served with a possession order or a suspended possession order.
  • If the proposed tenant would be occupying accommodation which is too large. For example, if a tenant who needs a one bedroom property requests a swap to a three-bedroom property. However, we may consider cases if you are giving up 4 bedrooms or more and the family you are exchanging with are an overcrowded Kensington and Chelsea tenant.
  • If the flat is too small for you. We will consider cases where moving will remove some of your extreme overcrowding or where you may be willing to use the living room as a bedroom.
  • If the accommodation is not reasonably suitable to the needs of the proposed tenant and their household. For example, if the property was specifically adapted for you and the proposed tenant does not need the adaptations.

You will be advised in writing if your request to exchange is refused.
